תקנון ותנאי שימוש

עודכן לאחרונה: 12 באוקטובר 2026. התקנון מנוסח בלשון זכר מטעמי נוחות, והוא מתייחס לכל המגדרים.

1. כללי

התקנון חל על השימוש באפליקציית "מעקב מים" ("האפליקציה"), בגרסת הרשת ובכל גרסה מותקנת. האפליקציה פותחה ומופעלת על ידי ליאב ("בעלי האפליקציה"). השימוש באפליקציה מהווה הסכמה לתקנון, למדיניות הפרטיות ולמדיניות ה-Cookies. מי שאינו מסכים לתנאים מתבקש שלא להשתמש באפליקציה.

2. מהות השירות

האפליקציה היא כלי למעקב אישי אחרי שתייה, עם תזכורות, סטטיסטיקה, הרגלים ומידע כללי. השירות ניתן כמות שהוא (AS IS), ללא תשלום, וללא התחייבות לזמינות, לדיוק או להתאמה לצורך מסוים.

3. לא ייעוץ רפואי

• האפליקציה אינה מכשיר רפואי, ואינה מחליפה ייעוץ, אבחון או טיפול של איש מקצוע.
• היעדים, ההמלצות, אחוזי הספירה, הערכות הקפאין והסוכר והתובנות הם הערכות כלליות.
• התשובות בעוזר השתייה הן מידע כללי עם קישור למקור. תשובות ה-AI נוצרות אוטומטית מתוך סיכומים של מקורות בריאות, ועלולות להיות שגויות, חלקיות או לא מעודכנות. יש לבדוק אותן במקור, ואין להסתמך עליהן להחלטה רפואית.
• במחלת לב, כליות או כבד, בהריון ובהנקה, אצל ילדים, או כשיש הנחיה רפואית להגביל או להגביר שתייה, יש לפעול לפי הצוות הרפואי.
• שתייה מרובה בזמן קצר עלולה להיות מסוכנת. בלבול, כאב ראש חזק, בחילה או הקאות אחרי שתייה מרובה, או סימני התייבשות קשה, מחייבים פנייה מיידית לעזרה רפואית (בישראל: מד״א 101).

4. אחריות המשתמש

• הנתונים נשמרים במכשיר שלך. האחריות לגבות אותם, ולשמור על קוד הנעילה ועל סיסמת הגיבוי, היא שלך. קוד או סיסמה שנשכחו לא ניתנים לשחזור.
• תזכורות, צלילים והתראות תלויים בדפדפן, במכשיר ובהגדרות שלו, ואין ערובה שיפעלו תמיד.
• אין להשתמש באפליקציה בדרך שמפרה דין, פוגעת באחרים או מנסה לפגוע באפליקציה, בקוד שלה או בשרתים שמארחים אותה.
• שירותים של צד שלישי שמופעלים לבחירתך, כמו תחזית מזג האוויר, זיהוי הדיבור של הדפדפן, אפליקציית המייל, שיתוף, ה-AI של Anthropic, בדיקת האנטי-בוט של Cloudflare וחיפוש ב-Google, כפופים לתנאים ולמדיניות שלהם. בעלי האפליקציה אינם אחראים להם.
• שאלות ל-AI: מותרות רק שאלות על מים, שתייה והאפליקציה, עד 5 שאלות ב-24 שעות. שאלה לא קשורה או לא הולמת לא תיענה, ואחרי 3 שאלות כאלה השאלות ל-AI ייחסמו ל-24 שעות. אסור לנסות לעקוף את ההגבלות, להפעיל את ה-AI באופן אוטומטי או לנצל אותו למטרה אחרת. בעלי האפליקציה רשאים לשנות את ההגבלות, להשבית את ה-AI זמנית או לצמיתות, ולחסום שימוש לרעה, בכל עת.
• גיל: האפליקציה מיועדת לשימוש מגיל 13. מתחת לגיל 18 השימוש הוא בהסכמת הורה.

5. קניין רוחני

הזכויות בקוד, בעיצוב, בטקסטים ובצלילים של האפליקציה שמורות לבעליה. מותר להשתמש באפליקציה לשימוש אישי. אסור להעתיק, להפיץ או למכור אותה, או גרסה שלה, ללא אישור בכתב.

6. הגבלת אחריות

במידה המרבית שהדין מתיר, בעלי האפליקציה לא יישאו באחריות לנזק ישיר או עקיף שייגרם מהשימוש באפליקציה, מאי-יכולת להשתמש בה, מאובדן נתונים או מהסתמכות על המידע שבה.

7. שינויים והפסקת שירות

בעלי האפליקציה רשאים לעדכן את האפליקציה ואת התקנון מעת לעת. תאריך העדכון האחרון מופיע בראש העמוד, ועל שינוי מהותי תוצג הודעה באפליקציה. בעלי האפליקציה רשאים גם להפסיק את השירות, כולו או חלקו, בכל עת.

8. דין וסמכות שיפוט

על התקנון יחולו דיני מדינת ישראל. סמכות השיפוט הבלעדית נתונה לבתי המשפט המוסמכים בישראל.

9. משוב

הצעות ומשוב שנשלחים אלינו עשויים לשמש לשיפור האפליקציה, בלי התחייבות ובלי תמורה. פנייה כזו לא מעבירה אלינו נתונים מהאפליקציה מעבר למה שבחרת לכתוב או לצרף.

1. General

The app is developed and operated by Liav (the "owner"). These terms apply to the Water Tracker app ("the app"), on the web and in any installed version. By using the app you agree to these terms, the Privacy Policy and the Cookie Policy.

2. The service

The app is a personal hydration tracking tool with reminders, statistics, habits and general information. It is provided free of charge, AS IS, without any warranty of availability, accuracy or fitness for a particular purpose.

3. Not medical advice

• The app is not a medical device and does not replace professional advice, diagnosis or treatment.
• Goals, recommendations, drink percentages, caffeine and sugar estimates and insights are general estimates.
• Answers in the drinking assistant are general information with a link to the source. AI answers are generated automatically from summaries of health sources and may be wrong, incomplete or out of date. Check them at the source, and do not rely on them for medical decisions.
• With heart, kidney or liver disease, during pregnancy or breastfeeding, for children, or with medical instructions to limit or increase fluids, follow your medical team.
• Drinking a lot in a short time can be dangerous. Confusion, severe headache, nausea or vomiting after heavy drinking, or signs of severe dehydration, require immediate medical help.

4. Your responsibility

• Your data is stored on your device. Backing it up and keeping your passcode and backup password safe is your responsibility; they cannot be recovered.
• Reminders, sounds and notifications depend on your browser and device and are not guaranteed to work.
• Do not use the app unlawfully, to harm others, or to attack the app, its code or its hosting.
• Third-party services you choose to use, such as the weather forecast, the browser's speech recognition, your email app, sharing, Anthropic's AI, Cloudflare's bot check and Google search, are subject to their own terms and policies. The app's owners are not responsible for them.
• AI questions: only questions about water, drinking and the app are allowed, up to 5 questions in 24 hours. Unrelated or inappropriate questions are not answered, and after 3 such questions AI questions are blocked for 24 hours. Do not try to bypass these limits, automate the AI or use it for other purposes. The owner may change the limits, turn the AI off temporarily or permanently, and block misuse at any time.
• Age: the app is intended for ages 13 and up. Under 18, use requires a parent's consent.

5. Intellectual property

All rights in the app's code, design, texts and sounds are reserved. Personal use is permitted; copying, distributing or selling the app or a version of it requires written permission.

6. Limitation of liability

To the maximum extent permitted by law, the app's owners are not liable for any direct or indirect damage arising from using or being unable to use the app, data loss, or reliance on its information.

7. Changes

The app's owners may update the app and these terms from time to time; the date at the top shows the latest version, and material changes will be announced in the app. The owners may also discontinue the service, in whole or in part, at any time.

8. Governing law

These terms are governed by the laws of the State of Israel, and the competent courts in Israel have exclusive jurisdiction.

9. Feedback

Suggestions and feedback you send may be used to improve the app, without obligation or compensation. Such a message passes us no data from the app beyond what you choose to write or attach.
